Provisión de su Majestad para que la Justicia, regimiento, concejo y vecinos del estado noble del lugar de Ablaneda, feligresía de Godán, informen a la sala, con justificación y citación de esta parte, sobre y en razón de lo contenido en la petición de la vuelta y, con igual citación de dicho concejo y vecinos, se la den los testimonios que pidiere y admitan las justificaciones que ofreciere.
En la Real Chancillería de Valladolid y a primero de Septiembre de 1.767.
Don Carlos, por la Gracia de Dios Rey de Castilla, de León, de Aragón, de las dos Sicilias, de Navarra, de Granada, de Toledo, de Galicia, de Mallorca, de Cerdeña, de Córdoba, de Córcega, de Murcia, de Jaén. Señor de Vizcaya y de Molina. Digo a vos la justicia, regimento, concejo, vecinos, y estado de hombres buenos, empadronadores y repartidores de ese lugar de Ablaneda, Parroquia de Godán; escribanos, archiveros y demás a quien tocare la ejecución y cumplimiento de lo que decido en esta nuestra carta y real Provisión se hará mención. Salud y Gracia.
Sabed que ante los nuestros Alcaldes de los Hijosdalgos de la nuestra corte y Cancillería, que reside en la ciudad de Valladolid, se presentó la petición del tenor siguiente:
Petición… «Muy Ilustre Señor Phelipe Cabeza Castañón en nombre de Lorenzo Cayao vecino de ese lugar de Ablaneda, feligresía de Godán, concejo de Salas; hijo legítimo de Bernardo Cayao y Francisca Marrón su mujer, vecinos que fueron del citado lugar y nietos con la misma legitimidad de Francisco Cayao y María de Vallina; vecinos que fueron de la parroquia de San Vicente, concejo de Villaviciosa. Digo:
que en parte de su Padre, Abuelo y demás ascendientes por línea recta de varones, el, y cada uno en su tiempo, fueron hijosdalgos notorios de sangre, en cuya quieta posesión siempre han estado en todas las villas y lugares donde han vivido y morado sin cosa en contrario gozando de todas las preeminencias y prerrogativas que los demás de igual estado; según que así mismo se le guardaron a dicho Bernardo, Padre de mi parte, quien con motivo de ciertas quintas hizo ausencia de la otra Parroquia de San Vicente, concejo de Villaviciosa al lugar citado de Ablaneda donde , para libertarse de semejante gravamen que no le correspondía, se mudo el nombre de Bernardo en Francisco, siendo el primero el que le corresponde, según se acreditará por las partidas de bautismo, casamiento y demás instrumentos.
Y no obstante haberse mantenido en dicha posesión por la justicia de dicho lugar de Ablaneda, se le ha inquietado en ella, dejándole de incluir en el ultimo padrón formado; y no siendo justo se le perjudique en su notoria nobleza suplico a Vuestra Alteza se sirva mandar se despache a mi parte su real Provisión para que la justicia informe el motivo que ha tenido para omitir el incluirle en el citado padrón, con justificación a la sala por ser de justicia que pido.

Royal Writ of Your Majesty so that the Justice, Regents, Council and residents of the noble state of Ablaneda -parish of Godan- inform the Court, with justification and citation of this party, about and pertinent to the contents of this petition in their return response and, with the same references, from the same council and residents, they provide the testimonies requested and admit the justifications offered.
In the Royal Chancery of Valladolid on September 1st, 1767.
Don Carlos, by the Grace of God, King of Castilla, León, Aragón, both Sicilias, Navarra, Granada, Toledo, Galicia, Mallorca, Cerdeña, Córdoba, Córcega, Murcia, Jaén, Lord of Vizcaya and Molina. I say to you, the Justice, Regiment, Council, neighbours and State of Good Men, Census Takers and Deliverers of Ablaneda, Parish of Godan, scribes, archivists and others who corresponds the implementation and fulfillment of what I decide shall be stated in this our letter and Royal Provision. Health and Grace.
Know that, before our Mayors of Noblemen of our Court and Chancery, which resides in the city of Valladolid, he submitted the following request:
«Most Illustrious Mr. Phelipe Cabeza Castañón, in the name of Lorenzo Cayado, resident of Ablaneda -parish of Godan, council of Salas-; legitimate son of Bernardo Cayado and Francisca Marrón, his wife, who were residents of the referenced place; and grandson, with the same legitimacy, of Francisco Cayado y María de Ballina, who were residents of San Vicente´s Parish, council of Villaviciosa = say:
That from his father, grandfather and other ancestors by direct male line; is and each, in its times, were, notoriously noble (Hijosdalgo) by blood; this quiet and peaceful property they have always enjoyed – in all the villages and places where they have lived and dwelled -, without argument to the contrary, enjoying all the privileges and prerogatives as others of equal status; as they were enjoyed by the aforementioned Bernardo, father of my father who, motivated by certain tax burdens, moved from San Vicente Parish, council of Villaviciosa, to the aforementioned Ablaneda; where, to avoid the same issue that did not correspond to his status, he changed his name from Bernardo to Francisco, being the first of them his proper name as will attest by the Baptismal Certificate, Marriage Certificate and other instruments.
And, despite being maintained in such possession by the Justice of the aforementioned Ablaneda, they have disquieted about it, and excluded his status from the latest census. And, not being just that he is harmed in his notorious nobility.
I beg of Your Highness to order a Royal Writ to be despatched to my party, so that the aforementioned Justice informs what motivation has caused his omission from the aforementioned census with justification to the Court for what I ask for is just.
